Schedule 11, Part 1, paragraph 4(6)

In the case of a school in England or Wales not coming within sub-paragraph (1), (2), (4) or (5) or an independent school in Scotland— the responsible body may submit to the Commission an application for the making of a transitional exemption order, and the Commission may make the order.
