Schedule 5, paragraph 17(2)

An order under sub-paragraph (1) must require those costs to be paid— where the appeal is allowed in full, by the Payment Systems Regulator; where the appeal is dismissed in full, by the appellant; where the appeal is partially allowed, by one or more parties in such proportions as the CMA considers appropriate in all the circumstances.
