Schedule 5, paragraph 8(1)

The CMA, if it thinks it necessary to do so for the purpose of securing the determination of an appeal within the period provided for by paragraph 7, may disregard— any or all matters raised by an appellant that were not raised by that appellant at the time of the relevant application, and any or all matters raised by the Payment Systems Regulator that were not contained in representations or observations made for the purposes of the appeal in accordance with paragraph 5.
