Schedule 3, Part 4A, paragraph 10J(1)

Where this paragraph applies and there is no agreement under paragraph 10I, the magistrates' court or sheriff— must transfer the application made under paragraph 10G to the relevant court if satisfied that the value of the forfeitable property and any associated property is £10,000 or more; may transfer the application made under paragraph 10G to the relevant court if satisfied that the value of the forfeitable property and any associated property is less than £10,000.
