Schedule 19, Part 2, paragraph 313

Regulation 7 of the Licensing Act 2003 (Personal Licences) Regulations 2005 (application for grant of a personal licence) is amended as follows. In paragraph (1)(b)— for paragraph (iii) (but not the final “, and”) substitute— the results of a request made under Article 15 of the GDPR or section 45 of the Data Protection Act 2018 (rights of access by the data subject) to the National Identification Service for information contained in the Police National Computer in the words following paragraph (iii), omit “search”. After paragraph (2) insert— In this regulation, “the GDPR” has the same meaning as in Parts 5 to 7 of the Data Protection Act 2018 (see section 3(10), (11) and (14) of that Act).
