Section 17(5)

Regulations may not provide for an offence under regulations to be punishable with imprisonment for a period exceeding— in the case of conviction on indictment, 10 years; in the case of summary conviction— in relation to England and Wales, the general limit in a magistrates’ court or, in relation to offences committed before 2 May 2022, 6 months; in relation to Scotland, 12 months; in relation to Northern Ireland, 6 months.
