Schedule 7, Part 1, paragraph 1(2)

Provision falls within this sub-paragraph if it— provides for any function of an EU entity or public authority in a member State of making an instrument of a legislative character to be exercisable instead by a public authority in the United Kingdom, relates to a fee in respect of a function exercisable by a public authority in the United Kingdom, creates, or widens the scope of, a criminal offence, or creates or amends a power to legislate.
