Schedule 18, Part 2, paragraph 11

The Upper Tribunal may, if it considers it reasonable to do so in connection with the modification under paragraph 6(1) of an obligation under a conservation covenant, include in the order modifying the obligation provision making the modification conditional on the entry by the applicant and the responsible body under the covenant into a conservation covenant agreement containing such provision as the order may specify. The power under sub-paragraph (1) is exercisable only with the consent of the applicant and the responsible body.
