Schedule 19, Part 1, paragraph 4(5)

But if the Crown grants an estate out of the land without having previously taken possession or control of the land, or entered into occupation of it— the acts of the Crown in granting that estate are not to be regarded for the purposes of Part 7 and this Schedule as taking possession or control of the land, or entering into occupation of it, and the new estate is to be regarded for those purposes as immediately derived from the determined estate.
