Schedule 3, Part 1, paragraph 14(3)

Where the OEP makes a review application, or an application for judicial review by virtue of paragraph 13(1), in which the relevant department is not a party, it must provide the relevant department with— a copy of the application, and a statement of whether the OEP considers the relevant department should participate in the review (for example, by applying to be a party).
