Schedule 10, Part 1, Chapter 2A, paragraph 309Z3(2)

Condition A is that— the person has at any time failed to comply with rules made under section 309Z1, and at that time the person was— a Part 18 approved person, an employee of a relevant recognised body, or a director of a relevant recognised body.
