Section 23(4)

Provision under subsection (3)(g) may include provision creating offences punishable on summary conviction— in England and Wales, with imprisonment for a term not exceeding 3 months or a fine, or both; in Scotland and Northern Ireland, with imprisonment for a term not exceeding 3 months or a fine not exceeding level 5 on the standard scale, or both.
