Section 3(8)

The power under subsection (1) to modify legislation does not include power to modify— primary legislation referred to in Part 4 of Schedule 1; technical standards of the kind mentioned in section 138P(2)(a) of FSMA 2000; EU tertiary legislation of the kind mentioned in section 138P(2)(b) of FSMA 2000.
