Section 71P(3)

Designated activity regulations may in particular— in cases where the regulations make provision for liability, make provision excluding civil liability (whether generally or to such extent as may be specified), make provision for liability to be determined in accordance with designated activity rules, make provision so that a person being subject to a liability includes another person being entitled as against that person to rescind or repudiate an agreement, and make provision for the purposes of subsection (1) by applying provisions of this Act with or without modifications.
