Schedule 2, Part 2, paragraph 31

A utilities contract for the supply of goods, services or works to a utility other than one acting as a centralised procurement authority, where— the purpose of the contract is to allow the further sale or lease of those goods, services or works to a third party, the utility does not have a special or exclusive right, within the meaning given by section 6(3), to sell or lease those goods, services or works, and other persons may sell or lease those goods, services or works under the same conditions as the utility.
