Schedule 4, Part 1, paragraph 5

An activity relating to the exploitation of a geographical area for the following purposes is a utility activity— the provision of an airport to carriers of passengers or goods by air; the provision of a port or other terminal facilities to carriers of passengers or goods by sea or inland waterway. In this paragraph “airport” has the same meaning as in Part 1 of the Civil Aviation Act 2012 (see section 66 of that Act).
