Schedule 8, paragraph 4

A modification is a permitted modification if— the circumstances giving rise to the modification could not reasonably have been foreseen by the contracting authority before the award of the contract, the modification would not change the overall nature of the contract, and the modification would not increase the estimated value of the contract by more than 50 per cent. Sub-paragraph (1)(c) does not apply if the contract being modified is a utilities contract.
