Section 30(1)

Subsection (2) applies if a contracting authority determines that— a supplier has acted improperly in relation to the award of a public contract, in consequence, the supplier is put at an unfair advantage in relation to the award, and the unfair advantage cannot be avoided other than by excluding the supplier.
