Section 49(4)

If there is no limit on the number of suppliers that can be party to a framework under an open framework, a contracting authority may award the framework to an existing supplier by reference to— the fact that the supplier has already been awarded a framework under the scheme, a tender relating to an earlier award under the scheme, or a tender relating to the current award.
