Subsection (2) applies if— a person has a supplementary note included in the DVS register relating to a supplementary code, the person applies for the note to be amended to record additional digital verification services that the person provides in accordance with that code, the person holds a certificate from an accredited conformity assessment body certifying that the person provides the additional services in accordance with that code, the application complies with any requirements imposed by a determination under section 38, and the person complies with any regulations under section 39(1) requiring a fee to be paid. The Secretary of State must amend the note to record that the person also provides the additional services referred to in subsection (1) in accordance with the supplementary code to which the note relates. But subsection (2) does not apply if the supplementary code to which the note relates has been withdrawn. If the conditions in paragraphs (a) to (e) of subsection (1) are not met, the Secretary of State may not amend the note as described in subsection (2). For the purposes of subsection (1)(c), a certificate is to be ignored if— it has expired in accordance with its terms, it has been withdrawn by the body that issued it, or it is required to be ignored by reason of provision included in the supplementary code as a result of section 29(9).
