Section 41.9

An order for periodical payments shall specify that the payments must be funded in accordance with section 2(4) of the 1996 Act, unless the court orders an alternative method of funding. Before ordering an alternative method of funding, the court must be satisfied that— the continuity of payment under the order is reasonably secure; and the criteria set out in Practice Direction 41B are met. An order under paragraph (2) must specify the alternative method of funding.
