Section 44.10(1)

Where the court makes an order which does not mention costs— subject to paragraphs (2) and (3), the general rule is that no party is entitled— in relation to that order; but to costs; or to seek an order under section 194(3) of the 2007 Act, this does not affect any entitlement of a party to recover costs out of a fund held by that party as trustee or personal representative, or under any lease, mortgage or other security.
