Section 45.12

If the criteria in rule 45.9(1) or rule 45.10(1) are not met, the court may make an order for the fixed recoverable costs and any permitted disbursements only. Where— the court may decide— the court makes an order for costs in accordance with paragraph (1); or rule 45.11 applies, to make no order as to the costs of the costs-only proceedings or detailed assessment; or to make an order for some or all of such costs to be paid by the party making the claim.
