Section 45.12(2)

Where— the court may decide— the court makes an order for costs in accordance with paragraph (1); or rule 45.11 applies, to make no order as to the costs of the costs-only proceedings or detailed assessment; or to make an order for some or all of such costs to be paid by the party making the claim.
