Section 65.47

This rule applies where a person is arrested pursuant to— a power of arrest attached to a provision of an injunction; or a warrant of arrest. The judge before whom a person is brought following his arrest may— deal with the matter; or adjourn the proceedings. If proceedings under section 43 or 44 of the 2009 Act or section 9 or 10 of the 2014 Act are adjourned and the arrested person is released— the matter must be dealt with (whether by the same or another judge) within 28 days of the date on which the arrested person appears in court; and the arrested person must be given not less than 2 days’ notice of the hearing.
