Section 68.5

If the Court of Appeal decides to accept a reference made to it in accordance with rule 68.3, a copy of the decision shall be sent to— each of the persons who made submissions under rule 68.4; and the parties to the proceedings before the referring court or tribunal. If any person listed in paragraph (1) wishes to intervene in the reference, an application to intervene must be made to the Court of Appeal under Part 23.
