Section 77.33

Part 52 (appeals) applies to an appeal to the Court of Appeal— against an order of the High Court on or in relation to an application under rule 77.23(1); and where the order under appeal was not made on or in relation to a matter within sub-paragraph (a) but the appeal proceedings involve such a matter. Paragraph (1) is subject to— this Sub-section; and paragraph (3) of this rule. The appellant must serve a copy of the appellant’s notice on any special advocate. Unless the court directs otherwise, an appeal to the Court of Appeal in proceedings under paragraph (1), must be determined at a hearing.
