Section 80.10

Subject to paragraph (2), the TPIM or Part 2 subject must give notice of appeal no later than 28 days after receiving— the extension notice, revival notice or variation notice that is the subject of the appeal; or notice of the Secretary of State’s decision on an application for permission in connection with a measure specified in the TPIM or Part 2 notice, for the revocation of the TPIM or Part 2 notice or for the variation of a measure specified in the TPIM or Part 2 notice. In a case where the Secretary of State has failed to determine an application for permission in connection with a measure specified in the TPIM or Part 2 notice, for the revocation of the TPIM or Part 2 notice or for the variation of a measure specified in the TPIM or Part 2 notice, the TPIM or Part 2 subject must file the notice of appeal— after the date on which the Secretary of State received the application. no earlier than 28 days, and no later than 42 days,
