Section 83.26(9)

An application for permission under paragraph (8) may be made without notice being served on any other party and must be supported by evidence of— wrongful re-entry into possession following the execution of the warrant of possession; and such further facts as would, in the High Court, enable the creditor to have a writ of restitution issued.
