Section 85.11

Part 39 will, with the necessary modifications, apply to the trial of an issue in an application under this Part as it applies to the trial of a claim. The court by which an issue is tried may give such judgment or make such order as finally to dispose of all questions arising in the application. Practice Direction 2B applies to the trial of an issue in an application under this Part.
