Part 81 does not apply to proceedings under this Part. In this Part— “the 1971 Act” means the Attachment of Earnings Act 1971 and unless the context otherwise requires or this Part otherwise provides, expressions used in that Act have the same meanings as in that Act; “creditor” means the person who has obtained or is entitled to enforce a judgment or order; “debtor” means the person against whom a judgment or order was given or made; “debtor’s employer” means any person appearing to be the debtor’s employer; “debtor’s home court” means the County Court hearing centre for the district in which the debtor resides or carries on business.
