An application to the court under section 16 of the Act of 1971 to determine whether payments to the debtor of a particular class or description are earnings for the purpose of an attachment of earnings order must be made to the debtor’s home court. Upon receipt of an application under paragraph (1), the court officer must— fix a date and time for the hearing of the application; and give notice of the hearing to the persons mentioned in section 16(2)(a), (b) and (c) of the 1971 Act.
