Section 34

In regulation 3 of the Telecommunications (Lawful Business Practice) (Interception of Communications) Regulations 2000 , for paragraph (3), there shall be substituted— Conduct falling within paragraph (1)(a)(i) above is authorised only to the extent that Article 5 of Directive 2002/58/EC of the European Parliament and of the Council of 12 July 2002 concerning the processing of personal data and the protection of privacy in the electronic communications sector so permits.
