Section 42

A person is guilty of an offence who— if they are not a specified person, fails to comply with regulation 25; or fails to comply with a compliance notice, stop notice or restoration notice. A person guilty of an offence under— is liable on summary conviction to a fine not exceeding level 5 on the standard scale. paragraph (1)(a); or paragraph (1)(b) in relation to contravention of regulation 25, A person guilty of an offence under paragraph (1)(b) in relation to contravention of regulation 12(1), 13(2) or 14(1) is liable— on summary conviction, to a fine not exceeding the statutory maximum; on conviction on indictment, to a fine.
