Section 47(1)

This regulation applies to radioactive waste— which is a specified waste; and in respect of which a person— is carrying on a radioactive substances activity described in paragraph 11(2)(b) or (c) or (4) of Part 2 of Schedule 23 to the Environmental Permitting (England and Wales) Regulations 2016; and is exempt from the requirement for an environmental permit under regulation 12(3) of those Regulations for that activity.
