Schedule 2, Part 2, paragraph 40

The Terrorism Act 2000 is amended as follows. In Schedule 3A (regulated sector and supervisory authorities) — in paragraph 1(b) (business in the regulated sector) for “Banking Consolidation Directive” substitute “ Capital Requirements Directive ” in both places where it appears; in paragraph 1(2)(a) for “Article 4(1) of the Banking Consolidation Directive” substitute “ Article 4(1)(1) of the Capital Requirements Regulation ”. in paragraph 1(2)(b) for “Article 4(3) of that Directive” substitute “ Article 4(1)(17) of that Regulation ”; in paragraph 3(1) (interpretation)— omit the definition of “the Banking Consolidation Directive”; and at the appropriate place insert— the Capital Requirements Regulation” means Regulation (EU) No. 575/2013 of the European Parliament and of the Council In paragraph 3(3) for “Banking Consolidation Directive” substitute “ Capital Requirements Regulation ”. In paragraph 6(1) of Schedule 6 (financial institution)— for paragraph (g) substitute— a European institution carrying on a home Member State regulated activity (within the meaning of Regulation (EU) No. 575/2013 of the European Parliament and of the Council); in paragraph (h) for “that Directive” substitute “ Directive 2013/36/EU of the European Parliament and of the Council of 26 June 2013, ”.
