Schedule 2, Part 3, paragraph 52

The Financial Services and Markets Act 2000 (Recognition Requirements for Investment Exchanges and Clearing Houses) Regulations 2001 are amended as follows. In regulation 3(1) (interpretation)— in the definition of “branch” for “Article 4.3 of the banking consolidation directive” substitute “ Article 4(1)(17) of the capital requirements regulation ”; in paragraph (a) of the definition of “credit institution” for “banking consolidation directive” substitute “ capital requirements directive ”. In paragraph 7B(4)(b) of the Schedule (recognition requirements for investment exchanges: access to the exchange's facilities) for “banking consolidation directive” substitute “ capital requirements directive ”.
