Section 45

Section 398 of FSMA (misleading FCA or PRA: residual cases) applies to a requirement imposed by or under— as it applies to a requirement imposed by or under FSMA. the capital requirements regulation; any of the Specified EU Regulations under the Capital Requirements Regulation, as amended from time to time; a technical standard made by the PRA or FCA under the functions conferred on them by the Capital Requirements Regulation as amended by Part 4, Chapter 3 of the Capital Requirements (Amendment) (EU Exit) Regulations 2018; or these Regulations;
