Schedule 3, Part 3, paragraph 12(4)

In article 3— in paragraph (2) after sub-paragraph (h) insert— any directly applicable regulation made under the recovery and resolution directive. in paragraph (3) after sub-paragraph (f) insert— in relation to a contravention of a requirement imposed by any directly applicable regulation made under the recovery and resolution directive— if the authorised person concerned is a PRA-authorised person, either the PRA or the FCA; in any other case, the FCA.
