Section 2(3)

In this Order any reference, in relation to a company, undertaking, subsidiary or other entity, to the country or territory in which the entity is set up is a reference to— the country or territory (as the case may be) in which the entity is authorised by an authority which, in the country or territory concerned, exercises any function equivalent to a function of the appropriate regulator; or if the entity is not authorised by such an authority, the country or territory in which the entity is incorporated or under whose law (including the law of any part of that country or territory) the entity is formed.
