Schedule 23, Part 2, paragraph 3(1)

In this Schedule, except as provided by paragraph 7, 8, 9, 9A or 10— “radioactive material” means a substance or article which is not waste, and which satisfies the requirements of paragraph 4, 5 or 6 as they apply to such a substance or article; “radioactive waste” means a substance or article which is waste, and which satisfies the requirements of paragraph 4, 5 or 6.
