Schedule 23, Part 6, paragraph 21(4)

Sub-paragraph (3) does not apply to aqueous radioactive waste— which a person has diluted with the intention that— the waste has a concentration of radioactivity which is below the value in sub-paragraph (3)(b), or the condition in paragraph 22(3)(a) or (4)(b) is complied with in respect of that waste, or where the person who generated that waste did not minimise the quantity of radionuclides generated as waste to the extent reasonably practicable.
