Schedule 26A, paragraph 16

The Agency must from time to time publish reports specifying — the cases in which a variable monetary penalty has been imposed on a person; and the cases in which a third party undertaking has been accepted from a person. In sub-paragraph (1)(a), the reference to cases in which a variable monetary penalty has been imposed does not include cases where a variable monetary penalty has been imposed but was overturned on appeal. This paragraph does not apply in cases where the Agency considers that publication would be inappropriate.
