Schedule 26A, paragraph 1(6)

The Agency may impose a variable monetary penalty of— any amount, in relation to an offence under regulation 38(1) to (4); or an amount not exceeding the maximum amount of the fine which may be imposed on summary conviction, in relation to an offence committed by an establishment or undertaking under regulation 38(5).
