Schedule 3, Part 4, paragraph 4(2)

For the purposes of this paragraph, the specific conditions are— the service crossing does not project more than 1 metre horizontally from the structure, the service crossing follows the existing cross-sectional profile of the structure to the main river in both normal and flood flow, the service crossing does not pass through any bank, culvert, flood defence structure or river control works on the main river or through any sea defence, permanent hazard markers are erected on both banks of the main river, and a notification has not been sent by the regulator to the landowner that the structure has been identified for removal or modification in order to achieve the environmental objectives in relation to a river basin district.
