Schedule 8, paragraph 5(3)

In this paragraph “substance” means any chemical element and its compounds and any biological entity or micro-organism, with the exception of the following substances— radioactive substances as defined in Article 4 of the Basic Safety Standards Directive; genetically modified micro-organisms as defined in Article 2(b) of Directive 2009/41/EC of the European Parliament and of the Council on the contained use of genetically modified micro-organisms ; genetically modified organisms as defined in point 2 of Article 2 of Directive 2001/18/EC of the European Parliament and of the Council on the deliberate release into the environment of genetically modified organisms .
