Schedule 9, Part 2, Chapter 1, paragraph 2(2)

In this Part — any reference to a “materials facility” excludes a facility or part of a facility— at which all the waste material received during a reporting period is attributable exclusively to a single supplier, unless the waste material so received is separated into specified output material at that facility; that is provided pursuant to arrangements made under section 51(1)(b) of the 1990 Act by an authority that is a waste disposal authority within the meaning of section 30(2) of that Act; that undertakes the processing or sorting of WEEE, waste batteries or accumulators; references to recycling, “recycled” or “recyclable” are to be construed in accordance with the meaning of “recycling” given in Article 3(17) of the Waste Framework Directive.
