Section 20(5)

Paragraph (4) does not apply if— the regulated facility is a standard facility, the regulator, on its own initiative, varies an environmental permit, or any condition of a permit, in order to comply with— an obligation under assimilated law, or a direction given by the appropriate authority under regulation 62, or the regulator, on its own initiative, varies an environmental permit, or any condition of a permit, in consequence of a transfer or partial transfer of an environmental permit under regulation 21.
