Section 32(5)

Subject to paragraph (5A), functions in relation to a regulated facility of the following description or class are exercisable by the local authority in whose area the regulated facility is or will be operated— a Part A(2) installation but not, from the transfer date, in respect of any medium combustion plant or specified generator, in so far as they are carried on at the installation; a Part B installation or Part B mobile plant, but not in respect of any of the following regulated facilities carried on at the installation or by means of mobile plant— a waste operation that is not itself a Part B activity; a mining waste operation; a water discharge activity; a groundwater activity; from the transfer date, a medium combustion plant or specified generator; a small waste incineration plant; a solvent emission activity.
