Section 4(3)

Section 33(1)(a) of the 1990 Act — does not apply to an operation which— falls within a description in Part 5 of Schedule 3, and meets the conditions specified in that Part for that description, and does not apply to extractive waste at any time before the requirement for an environmental permit under regulation 12 applies in respect of the deposit of that waste.
